Leaving Home in Iddat to Visit Kids

Q: If a lady is 62 years old and her husband dies and she stays at home for 2 months of iddah. Thereafter she says that she wants to move out to see her children (who are married and their houses are nearby), would it be  permissible for her to move out for this reason?

A:
It is not permissible for her to move out, irrespective of her age. She has to compulsorily complete the Iddat without moving. Seeing her children is not a valid reason for her to leave the Iddat house. The children can visit her.

If a woman observing iddat is in real danger of losing life or limb, or she suffers from acute fear when alone, then she may leave her home and stay in a safer place. (Fataawa Hindiyyah V1 P535, Aljauharatun Nayyirah V4 P310).

She cannot leave for any other reason.

Q: If someone's husband murders his daughters and then commits suicide, does the iddah apply to the widow? She belongs to well to do family but she wants to work. Can she do that?

A:
The Iddah will still apply.

She will not be allowed to work during the Iddah if she is able to sustain herself or family can sustain her.

Q: Is it permissible for a widow to perform umrah after completing 40 days of her husband's death? Just umrah and nowhere else.

A:
A woman in is not allowed to go for Haj during her Iddah. (Fataawa Al Hindiyyah V1 P219). So Umrah during the Iddah is definitely not allowed.

The Iddah period after the demise of the husband is 130 days. She may only leave the house of Iddah thereafter.

Going on Holiday in Iddat

Q: Can a widow in iddat (waiting period) go to on holiday with her son and his family after three months of iddat? The widow is more than 50 years old. What will happen if she goes on holiday during the iddat?

A:
The Iddat of a widow is one hundred and thirty days. It is not permissible for her to leave the Iddat home for the purpose you mentioned. Iddat is a command from Allah Ta'aala and His Rasool (Sallallaahu Alayhi wa Sallam). Breaking a command of Shari'ah is a major sin. If she goes, she will be committing a major sin. She must remain and complete her Iddat. She may travel anywhere after the Iddat is over.

Q: I am a working lady. In the iddat period I want to work from home so can I talk over the phone to non mahram (marriageable male)? I am taking Khula, what will be my iddat period?

A:
It will be permissible for you to work from home. If necessary you may speak to the non Mahram according to need.

The Iddat period is the same as for a divorced woman:

For a woman who experiences Haidh (monthly menses) the Iddah is three Haidh. For a woman who does not experience Haidh it is three months and for a pregnant woman it is delivery of her baby.

Q: If your husband has given you all 3 talaaqs (divorces) via sms what is your iddah (waiting) period ? I have heard that it's just 40 days but have learned that it supposed to be 3 menstrual cycles.

A:
The Iddah period is three menstrual cycles.
