Q: My question is are we to follow Saudis on Arafah or are we to do it according to sighting the moon locally? And if we are to follow Saudis then will fasting on the ninth day based on local sighting be haraam?

A:
You will follow your local moon.

That fast will not be Haraam.

Cutting Nails before Ihram of Hajj

Q: I am performing hajj tamattu this year. Can I cut my hair and nails before entering into ihram for Mina/Arafat, since I am not performing umrah before Arafat day as I have already performed it. Also is intercourse permissible during this time as there are only a few days left before Arafat day?

A:
You can cut your nails, etc. before entering Ihraam for Haj and intercourse is also permissible before Ihraam.

Meelad Equaling Hajj

Q: Is it true that if you go for 11 meelads it is equivalent to 1 Hajj?

A:
It is not true that attending 11 meelads is equivalent to 1 Hajj. Any virtue for good deeds must be established from Quran or Sunnah. There is no mention in the Quran of meelad at all, and meelaad never existed in the time of Rasoolullah (sallallahu alayhi wasallam) nor in the time of the Sahaba. So it was impossible for such a virtue being mentioned. This is totally fabricated and false. We cannot make up our own virtues for certain practices.

Hajj Badal

Q: If we send someone for Hajj Badal (to send someone on behalf of another person for Hajj), is it necessary that that person must have perfomed his Hajj previously? Can we send someone on whom Hajj is Fardh, but he did not perform his own Hajj?

A. Why are you sending someone for Haj on your behalf (you wrote: "on behalf of us")? Can you not perform Haj yourself? If you are able to perform Haj yourself then it will not be correct to send someone else on your behalf.

Usually a person is sent for Haj on behalf of a deceased person.

If Haj is already Fardh on a person then for him or her to perform Haj Badl for someone else while delaying his or her own Fardh Haj is sinful and close to Haraam (Makrooh Tahreemi). (Badaai’us Sanaai’)

The sin is for delaying one's own Haj which has already become Fardh; hence the person being sent for Haj-e-Badal should first perform his own Haj before a Haj for someone else.

If Haj is not Fardh on one and he performs Haj-e-Badal, it is not advisable (Makrooh Tanzeehi). In both cases the Hajj-e-Badal will be valid. (Al Bahrur Raa'iq V3 P74)

Debts and Hajj

Q: I have debts on a car and credit cards. However a sponsor has offered to take me for haj. What is the ruling in this case?

A: If someone sponsored you for Hajj, your hajj will be valid in spite of these debts

Covering Ankle in Ihraam

Q: Can the Hajj/Ihram sandal have a strap around the ankle? My understanding is that the top of the foot and the area that the leg is joined to the foot ie the ankle should be uncovered.

A: Your understanding is correct. The upper bone and the ankle should not be covered when one is in the state of Ihraam.
