Q: My husband and I had an argument and he said some hurtful things which he often says when we have our arguments.The next day we were talking and he asked me if I wanted a seperation. I said yes and he immediately mumbled Talaaq,Talaaq,Talaaq and got out of the car. Please advise if this terminates the nikkah (marriage).

A. Three Talaaqs have taken place and there is no possibility of reconciliation unless you marry someone else, but such a marriage must not be planned and arranged by the husband or yourself. You will now have to undergo the Iddat period.

Q: Is it permissible to work at financial services institutions such as Sanlam, Old Mutual and Metropolitan Life. These institutions deal with Retirement Funds, Insurance (long term and short term), Investments, estate planning, etc.

A. It is not permissible to work for these institutions because most of the financial products they sell contain the element of Ribaa (interest). Insurance also has a Ribaa factor in it. The Ahaadeeth prohibit participation in Ribaa on every level. (Abu Dawood V3 P249)

Q: Are Cyber Online jobs permissible?
 
A: Cyber Online Jobs are permissible because in these deals one gets paid for doing work, and this is totally halaal and permissible.
 
However, if in any online job one is required to do something haraam, e.g. advertising or promoting pornography or cbyer sex etc, then that particular job will be haraam and the income received will also be haraam.

Q: Can we pay off our mortgage with interest money?

A: A mortgage bond may not be paid off with interest money. Interest or usury must be given to the poor or used for the benefit of the general public in amenities such as public toliets and bathrooms, building bridges and roads etc.

It is not even permissible to pay off the interest of a bond with interest money acquired from another financial institute.
 
However, if one received interest from the same financing house where the mortgage has been taken out, then it will be permissible to use the interest money to pay of that bond, because then you are simply giving back to the company (bank etc) its own money.

Q: I have a question about permissability of accepting employment with prospective employers. What type of businesses is one not allowed to be employed by? Can one be employed by a butcher business that sells halaal and non-halaal meats? Or retail stores that sell clothing and/or food that one is not allowed to wear and/or eat?

A: In today’s times there are thousands of different types of professions and jobs. Some of these are totally contrary to Shariah, while others contain one or more elements that are haraam. We cannot give a general ruling or blanket statement to govern all of these. Each employment must be considered separately as the ruling will differ from one employment to another. We advise people to ask about the particular job they intend intend taking up.

Regarding the butchery, it is haraam to work in a non Muslim butchery because all the meat is haraam and they will also sell pig. However, if one is employed there to supervise halaal meat that is sold, and one is certain that such meat really comes from a halaal source, then such employment is lawful. In that case, the employee has to be extra-vigilant in making sure only halaal meat is sold.

As regards retail stores, working there is totally permissible, regardless of the type of clothing they sell.

Q: I owe creditors few thousand rands for products provided to me when I once had a business. I had to close the business. At that point in time I could not pay these creditors. A few years have passed by and I am now in a position to pay them but cannot trace them. I have tried several times to locate them but to no avail. I do not want to owe them as I know the repercussions of unpaid debt. What is the best way forward?
 
A: 
The way forward is encapsulated in the following list:
 
1.Try and trace the relatives of these creditors and hand over the money to them.
2. If the relatives too, are untraceble, then IF THE CREDITORS ARE MUSLIMS, give the amount you owe them to poor Muslims or non-Muslims as charity, but don't have any intention of reward becasue the reward will accrue to your creditors.

Q: Is there any medical insurance/health plan in South Africa that is permissible? I'm specifically looking for one that caters for a giving birth at a hospital.
 
A: Not all medical aids and hospital plans are permitted. As a guide, if a female intends to fall pregnant and wishes to take out medical aid for this purpose, then this is permissible for she is certain to use the benefits of the scheme, and she is definitely going to continue paying premiums even after childbirth, thus ensuring that extra money used up for the birth is paid in later on. This eliminates the interest factor.

Some medical aid schemes work like a savings account. These will also be permissible. You can get details from the various service providers in this field. Feel free to contact us for more information.
