Q: My husband and I had an argument and he said some hurtful things which he often says when we have our arguments.The next day we were talking and he asked me if I wanted a seperation. I said yes and he immediately mumbled Talaaq,Talaaq,Talaaq and got out of the car. Please advise if this terminates the nikkah (marriage).
A. Three Talaaqs have taken place and there is no possibility of reconciliation unless you marry someone else, but such a marriage must not be planned and arranged by the husband or yourself. Q: I have planned for Hajj this year Insha Allah. I am presently working but not earning that much where I can afford to pay for Hajj. My father is giving me a gift and has told me to go for Hajj. Will my Farz Hajj be complete? A. Yes, your Fardh Haj will be complete. When you begin your Haj, make the intention of a Fardh Haj. Q: I took a loan from my wife to purchase a car. The value being for example R30,000. I have paid her R5,000 thus far. Thus, I am in debt of R25,000. Question: If I have cash and jewelry to the value of R28,000, what amount will I pay Zakaat on? If I have cash and jewelry to the value of R20,000, will Zakaah need to be paid? Will my wife be liable to pay zakaah on the R25,000 I owe her? A: 1) With regard to your cash and jewellery to the value of R28,000.00 you must deduct what you owe on the car (R25,000) and pay zakaat on the balance, which is R3000.00. Zakaat on this amount is R75.00. 2) Zakaat on cash and jewellery to the value of R20,000 has to be paid. But if after deducting your debts, the balance is less than R3,000. (which is the nisaab of zakaat), you don't need to pay zakaat. 3) Your wife does not need to pay zakaat on the R25,000 you owe her right now. When she receives payment from you of R3,000 or more, then she must pay zakaat on that amount. And Allah knows best Mufti Siraj Desai |

Q: I had my monthly periods before Ramadaan started. Now I spot every other day and it is not the whole day. Should I pay these days back? A: There is some explanation that needs to be given with regard to your situation. Please read the following carefully and feel free to write back if there is any further query. 1. If you have a fixed cycle for your monthly flow, such as 7 days, or 8 days, and now you have passed that number of days and the spotting continues, then you must regard the previous fixed cycle as your menses. The rest of the days are istihaadah, meaning that you must still fast and make salaah but for salaah you need to make wudhu for every new salaah time. 2. If there is no fixed cycle then consider your haidh as 10 full days (if the spotting continued as you say) The rest of the days of spotting are istihaada which have the same rule as above, i.e you must fast and offer salaah. 3. If you had not fasted during the days of istihaadah then remember that you have to pay back these fasts after Ramadaan. 4. Also remember that if you have a 15-day clean, dry period wherein there is no flow or spotting, then the next time after that any blood flow or spotting that occurs will be a new haidh or menstruation.

Q: In Ramadhan a person deliberately broken his/her fast or is not keeping fast, what are the consequences and what is the compensation that person has to make for each fast that has been broken?
A. If a person starts fasting then breaks the fast without a valid reason, he will have to keep Kaffaarah of sixty consecutive fasts as well as one Qadhaa, totalling sixty-one days. It is necessary that the sixty days of Kaffaarah be kept consecutively. If a person misses one day of fasting at any stage during the sixty days, he will have to begin that Kaffaarah all over again, even if he had fasted 59 of the 60 days. If it is a lady, her Haidh (periods) in-between will not be considered as missing a few days. She will have to carry on with the Kaffaarah as soon as her Haidh is over.
If a person broke a few fasts, he will keep one Kaffaarah and Qadhaa of the days missed. (Ahsanul Fataawa V4 P434)
If one does not observe the fasts of Ramadhaan, there is no Kaffaarah, only Qadhaa for each fast missed. However, the sin is equally major. The Hadeeth Shareef states that one who misses one fast of Ramadhaan without illness or a valid excuse, will not be able to make up for the reward of that day even if he has to fast his entire lifetime. (Fazaa-ile A’maal)
Fasting is Fardh and the person who neglects a Fardh is neglecting a direct command of Allah Ta'aala and one cannot imagine the punishment for such violation of the command of Allah.
May Allah grant all Muslims the guidance to fulfil their duty towards Him, Aameen.

Q: My father is retired and he took his pension fund and all his retirement money from goverment. Does he have to pay Zakat on this money? A: If he was paying Zakaat previously, he will add the money he received from his pension fund to other assets and pay Zakaat on the whole amount on the date Zakaat is due. If he was NOT paying Zakaat before this, then he will only pay Zakaat on the pension fund after it has been in his possession for 12 Islamic months. Allah Ta'aala knows best. Q: I would like to know how should zakaat be calculated on the Mandela Coin. It was bought for about R4,000.00 and now the value is about R20,000.00. Iit contains one ounce of gold. Will zakaat be paid on the gold content or the value of the coin? A: Zakaat has to be paid on the gold content of the coin, not on its inflated value. It is clear that the substantial value of this coin is not due to any increase in the gold price; instead it is the name the coin bears that enhances its value, as well as market demand. Q: What is needed to be done in order to seek Allah Ta'aala's mercy when a Muslim intentionally breaks a Ramadaan fast knowingly? A: The only way to get Allah's mercy if one had broken a fast intentionally is to compensate for that act by fasting 60 days one after the other. This is called kaffara. A person who breaks a fast intentionally has to keep this kaffara to make up for the wrong-doing. If one does not do this, he will not earn Allah's Pleasure.
