Q: My husband and I had an argument and he said some hurtful things which he often says when we have our arguments.The next day we were talking and he asked me if I wanted a seperation. I said yes and he immediately mumbled Talaaq,Talaaq,Talaaq and got out of the car. Please advise if this terminates the nikkah (marriage).
A. Three Talaaqs have taken place and there is no possibility of reconciliation unless you marry someone else, but such a marriage must not be planned and arranged by the husband or yourself. Q: Is Reiki treament allowed in Islam? A. The Reiki treatment is three dimensional; physical, mental and spiritual. Shari'ah does not accept any type of spirituality except that which is from Qur'aan and Sunnah. Because of the spiritual dimension of Reiki, it will not be permissible to undergo this type of treatment. Allah Ta'aala knows best.

Q: How should zakaat be calculated on inheritance money which one recieves. The money was only recieved several years after the deceased had passed away. Should it be calculated from the day that the deceased passed away or from the time the money was recieved? Will there be a difference if the estate was wound up immediately upon death or if it was wound up a few years later? A: There is no Zakaat on inheritance that has not yet been paid out. Once the heir receives his/her share, the Shar'i year will be calculated from that point onwards, provided the sum received is equivalent to Nisaab. Q: I have a skin irritation problem that has causes me alot of grief. Different doctors have told me different things and their prescriptions just over temporary relief. So I opted to use the Quraan as I do believe the words of Allah have power over any ailment. I even use black cumine seeds and honey everyday with my breakfast, but my skin problem just won't go away. What am I doing wrong? Am I using the wrong prayers? What must I do? Why are my supplications not yelding results?
A: Illness is from Allah and He gives disease and illness for various reasons. Illness wipes out sins and is a test from Allah. Sometimes Allah gives a person a lesser illness to ward off a bigger or more seriois sickness. Ilness elevates the spiritual rank of a person. For these reasons you need to be positive and resign yourself to the taqdeer of Allah As regards the duas and verses you are reading, as well as the remedies you are adopting, you must understand that all these are subject to the permission of Allah. Verses and duas will only take effect if Allah Ta'ala permits such effect. That is why, many a time people read their duas etc for protection, yet a calamity still befalls them. This is a clear sign that such a calamity was ordained by Allah and nothing could stop it from happening. I must add, though, that most of the time. with His permission, these duas and verses help in curing people warding of illnesses. Many people have experienced this. Sadly, in your case it has not worked so far. It might work later. But the main reason for such duas etc not having any effect is that Allah Ta'ala has decreed a condition for you and He has also decide this condition will remain for an extended period. There is nothing but good in such a situation, as explained in my first paragraph. Also don't believe that you are doing something wrong for which you are being punished. Yes, if there is a major sin that you are committing, then you should desist from that sin immediately. Do not stop making dua nor srop reading the verses and wazeefas for cure. I make dua that Allah Ta'ala grants you complete Shifaa and removes all affliction from you sooner than later. Aameen If you haven't yet tried this, read the folllowing: SALAAMUN ALAA NOOHIN FIL-AA'LAMEEN SALAAMUN QOWLAN MIN RABBIR-RAHEEM Read as much as possible and blow on the skin Also try massaging the skin with olive oil. When doing so, recite the durood or salawaat on Rasool.

Q: I took a loan from my wife to purchase a car. The value being for example R30,000. I have paid her R5,000 thus far. Thus, I am in debt of R25,000. Question: If I have cash and jewelry to the value of R28,000, what amount will I pay Zakaat on? If I have cash and jewelry to the value of R20,000, will Zakaah need to be paid? Will my wife be liable to pay zakaah on the R25,000 I owe her? A: 1) With regard to your cash and jewellery to the value of R28,000.00 you must deduct what you owe on the car (R25,000) and pay zakaat on the balance, which is R3000.00. Zakaat on this amount is R75.00. 2) Zakaat on cash and jewellery to the value of R20,000 has to be paid. But if after deducting your debts, the balance is less than R3,000. (which is the nisaab of zakaat), you don't need to pay zakaat. 3) Your wife does not need to pay zakaat on the R25,000 you owe her right now. When she receives payment from you of R3,000 or more, then she must pay zakaat on that amount. And Allah knows best Mufti Siraj Desai |

Q: If you start your period (menses) 40 minutes before iftaar time, after you have prayed Asr, is your fast still counted? Also if you don't check but you know you have started bleeding and you check after Iftar and this confirms what you perceived would you still have to keep Qadha? I remember somebody telling me if you start after Asr your fast is valid. A. Even if the menses start a minute before Iftaar, Qadhaa of that fast will be compulsory. (Sharhul Wiqaayah P115). Merely ‘feeling’ or ‘knowing’ that blood has flowed is not regarded as the start of menses. However, when she does a check afterwards and discovers that indeed blood has flowed out onto the underwear, or has soiled the pad, if any, then it will be said that her Haidh had commenced from the time she felt the initial flow. In that case, the fast has also been nullified and Qadhaa has to be kept after Ramadhaan. If upon checking the woman discovers that blood had not flowed out onto underwear or outer pad, then she can consider the fast intact for her Haidh had not yet commenced. Q: I had my monthly periods before Ramadaan started. Now I spot every other day and it is not the whole day. Should I pay these days back? A: There is some explanation that needs to be given with regard to your situation. Please read the following carefully and feel free to write back if there is any further query. 1. If you have a fixed cycle for your monthly flow, such as 7 days, or 8 days, and now you have passed that number of days and the spotting continues, then you must regard the previous fixed cycle as your menses. The rest of the days are istihaadah, meaning that you must still fast and make salaah but for salaah you need to make wudhu for every new salaah time. 2. If there is no fixed cycle then consider your haidh as 10 full days (if the spotting continued as you say) The rest of the days of spotting are istihaada which have the same rule as above, i.e you must fast and offer salaah. 3. If you had not fasted during the days of istihaadah then remember that you have to pay back these fasts after Ramadaan. 4. Also remember that if you have a 15-day clean, dry period wherein there is no flow or spotting, then the next time after that any blood flow or spotting that occurs will be a new haidh or menstruation.

Q: Is it permissible to work at financial services institutions such as Sanlam, Old Mutual and Metropolitan Life. These institutions deal with Retirement Funds, Insurance (long term and short term), Investments, estate planning, etc.
A. It is not permissible to work for these institutions because most of the financial products they sell contain the element of Ribaa (interest). Insurance also has a Ribaa factor in it. Q: In Ramadhan a person deliberately broken his/her fast or is not keeping fast, what are the consequences and what is the compensation that person has to make for each fast that has been broken?
A. If a person starts fasting then breaks the fast without a valid reason, he will have to keep Kaffaarah of sixty consecutive fasts as well as one Qadhaa, totalling sixty-one days. It is necessary that the sixty days of Kaffaarah be kept consecutively. If a person misses one day of fasting at any stage during the sixty days, he will have to begin that Kaffaarah all over again, even if he had fasted 59 of the 60 days. If it is a lady, her Haidh (periods) in-between will not be considered as missing a few days. She will have to carry on with the Kaffaarah as soon as her Haidh is over.
If a person broke a few fasts, he will keep one Kaffaarah and Qadhaa of the days missed. (Ahsanul Fataawa V4 P434)
If one does not observe the fasts of Ramadhaan, there is no Kaffaarah, only Qadhaa for each fast missed. However, the sin is equally major. The Hadeeth Shareef states that one who misses one fast of Ramadhaan without illness or a valid excuse, will not be able to make up for the reward of that day even if he has to fast his entire lifetime. (Fazaa-ile A’maal)
Fasting is Fardh and the person who neglects a Fardh is neglecting a direct command of Allah Ta'aala and one cannot imagine the punishment for such violation of the command of Allah.
May Allah grant all Muslims the guidance to fulfil their duty towards Him, Aameen.
