Q: My husband and I had an argument and he said some hurtful things which he often says when we have our arguments.The next day we were talking and he asked me if I wanted a seperation. I said yes and he immediately mumbled Talaaq,Talaaq,Talaaq and got out of the car. Please advise if this terminates the nikkah (marriage).

A. Three Talaaqs have taken place and there is no possibility of reconciliation unless you marry someone else, but such a marriage must not be planned and arranged by the husband or yourself. You will now have to undergo the Iddat period.

Q: Is music with beats Haraam in Islam even if the lyrics are clean?

A: Allaamah ibni Katheer records a narration in his Tafseer under verse 6 of Surah Luqmaan: And of mankind is he who purchases idle talks… Sayyidina Abdullah ibni Mas'ood (Radhiyallaahu Anhu) was asked regarding the meaning of idle talks. He answered thrice under oath that it refers to music. (Tafseer ibni Katheer V6 P330). This is also the verdict of other scholars of that time, including Sayyidina Hasan Basri (Rahmatullaahi Alayh).

 

Sayyidina Abu Maalik Al Ash'ari (Radhiyallaahu Anhu) narrates that Rasulullah (Sallallaahu Alayhi wa Sallam) said: Some people among my Ummah will consume alcohol whilst giving it another name. Their gatherings will consist of music and dancing girls. Allah will let the earth swallow them and some of them will be transformed into apes and swine. (Sunan ibni Maajah V2 P1333).

All types of musical instruments are forbidden, irrespective of the type of lyrics. May Allah Ta'aala save us. Aameen.

Q: When travelling is it compulsory or advisable to read qasr salaah (shortened prayer) or can one perform the full salaah?

A: If one is travelling the distance which makes one a Musaafir, it will be necessary to perform Qasr. The Sunnah can be performed if one wishes.

Q: Can we give all our Fitra (from all the family members combined) to only one Sharee Fakir (Poor person who can accept Fitra Islamically)?

A: Yes, the whole family's fitra can be given to one shar'ee fakir. This is jaaiz and lawful.

Q: I am a single divorced mother of a 10 year old son. He isn't baaligh as yet. I am by the means to go for umrah/hajj. I don't have any brothers, uncles or a father and grandfather. Is it permissible to go for hajj/umrah with my son as mahram even though he isn't baaligh yet?

A. A boy who is not Baaligh cannot serve as a Mahram on journey. (Fataawa Al Hindiyyah V1 P219). One of the conditions of Haj becoming Fardh on a female is a Mahram. If you do not have another Mahram available, Haj will not be Fardh on you. If no one else is available, you will have to wait until he becomes Baaligh.

Q: Can one keep the first Shawwal fast immediately after Eid and then continue the other five during the course of Shawwal or does one need to keep two and then continue the rest during Shawwal?

A: You may keep the six fasts of shawwaal any time after Eid, immediately or days later, consecutively or intermittently. All ways are permissible.

Q: Do I have to pay zakaat on trading stock in my business and how do I calculate it?
 
A: Yes you have to pay zakaat on business stock. Calculate such stock according to current market value; i.e. the price you would currently pay for the same stock if you had to purchase it from the wholesalers on the day your zakaat is due. This can be obtained by phoning the wholesalers to find out current prices. If prices vary, then work on an average or middle-ranged price.

Q: I had a miscarriage and had bleeding for 2 weeks after. It then stopped, and I made ghusl and made salah etc. After a 10 day clean period I started spotting again and have continued to do so. However, I regarded this as Istihaadah and continued to make salah and fast. Is this correct?

A: You were correct to regard such bleeding as istihaadha. So continue fasting and making salaah, while renewing wudhu for every new salaah time.

Q: Is zakaat payable on capital amount invested in a business or only on the profits gained?

A: In business zakaat must be paid on the current value of one's share in the business, notwithstanding the amount initially invested, on condition that the investor has entered into a partnership (Islamic Shirkat) with one or more people in that enterprise. For example, if one invested R100,000.00 in a business, then consider what percentage of the total value of the business does that sum represent. If it represented 20 percent (for example) of the total value, then the investor owns 20 percent of the business and when the zakaat year is up he or she must pay zakaat on 20 percent of the value of the business at that point in time. Assuming, in the above example, the business is valued at one million rands, then the investor must pay zakaat on R200,000.00 because this amount represents 20 percent of a R1m. Two and a half percent of this amount will be taken out for zakaat purposes.
 
NOTE: Such evaluation has to be market related, so partners cannot just assume a nominal or token value for zakaat purposes.
 
As regards profits, these generally form part of of one's cash assets. So by calcualting 2.5 % of total cash at the end of the zakaat year, the profits's zakaat would be taken care of. One does not need to separately calculate zakaat on total profits earned for the entire year.

Q: My wife is pregnent and did not fast in Ramadaan. How much does she have to pay for fasts missed?

A: She will keep the missed fasts as Qadhaa later (after pregnancy) when she is able. Only a person who is terminally ill and has no hope of recovery is allowed to pay Fidyah for missed fasts.

Q: Can a woman who is menstruating during Ramadaan eat during the day as I heard that it is haraam for her to eat during the day?

A:
It is permissible for a woman to who is menstruating to eat during the day in Ramadaan. This is not haraam. But she should eat in private, not in public, though even this is not haraam, just preferred.

Q: Is Reiki treament allowed in Islam?

A. The Reiki treatment is three dimensional; physical, mental and spiritual. Shari'ah does not accept any type of spirituality except that which is from Qur'aan and Sunnah. Because of the spiritual dimension of Reiki, it will not be permissible to undergo this type of treatment.
